Refund Policy
ADE Hosting has developed and strictly adheres to the following refund policy for web hosting services. Refund policy includes the number of guarantees, such as 30-days money back guarantee and any-time money back guarantee. We appreciate the fact that you have chosen us as your web hosting provider and value you as our customer. If we do not meet your requirements or you have other reasons, you are free to cancel the web hosting account with us, and you will receive a refund according to the following terms. 1. If you are within first 30 days of your web hosting contract we will return you 100% of money you have paid for web hosting. 2. If more than 30 days have passed since your web hosting account was established our any-time guarantee will apply. The terms of this option are that you will receive a refund of the unused prepaid portion. The account balance will be calculated on a daily basis. You can easily view your web hosting account balance by using the user control panel that we provide you. The amount of the refund will be equal to the account balance in your account on the day the cancellation is effective. 3. This refund policy will apply to all web hosting packages regardless of the currency used for payment or the billing period chosen. 4. All requests for account cancellation must be submitted in writing. It will be necessary for the customer to provide the real reason for canceling the account. At this time ADE Hosting's customer care team will attempt to respond to the customer’s needs in a positive way in order to meet the requirements, and needs of the customer in order to correct any issues and satisfy the customer. 5. Please note that if you have more than one web hosting account with us and only cancel one of the them, the refunded amount can not be transferred to any other of your web hosting accounts that you have with ADE Hosting. 6. If you have requested a refund, but still have unpaid over usage fees due, you will be financial responsible to pay for the excess traffic used over the amount allocated to you by your web hosting plan. 7. The refund fees should be transferred within 5 business days after receipt of cancellation request. Refund shall be given in the currency you have chosen at the moment of ordering web hosting account. 8. The refund policy does not cover: 9. Fees for traffic over usage paid according to web hosting Terms of Services. 10. Domain name registration, domain name registration transfer to ADE Hosting, Whois privacy service fees and domain name renewal charges are not refundable once 24 hours from the moment of registration or renewal have passed (due to ICANN policy and regulations). The domain name is being registered on your name and you are the only owner of the domain name. ADE Hosting reserves the right to modify the present refund policy at any time without any prior notice to you. It is your sole responsibility to check website for any changes and modifications to the present refund policy.
Terms of services
1. General terms and conditions All services provided by ADE Hosting ("Provider") are provided to customer ("User") under the Terms and Conditions set forth in this Terms of Services ("TOS"). TOS comprises the entire agreement between User and Provider and represents the rules and regulations for using Provider's services. Please read them carefully and ensure that you understand and agree to ALL parts. Entering into a subscription with the Provider for services implies that User agrees with the terms set forth in the TOS and all another policies adopted by Provider and published on the official web site of Provider. This TOS is subject to the governing laws of the USA , and the laws of State of Louisiana. Provider feels responsible to protect each User and provide them with the best service possible. The following protocols are designed to allow us to maintain services of the highest quality and to provide safe guards and to recognize the rights of the User and others who use the service by establishing this TOS. Provider will be the sole arbitrator as to what constitutes a violation of any provision of these TOS. 2. Authenticity of information When ordering and establishing an account User must provide valid, true, accurate and complete information about yourself to properly register domain/order web hosting account and submit questions about the services your are ordering. Once User’s hosting account is set up and the domain name is registered, the terms of the registration agreement requires him to update and correct his contact information whenever a change occurs. This will allow Provider to handle User’s account properly (including sending notifications regarding User’s account or verifying any parts of his contact information). If User is establishing an account on behalf of another person, it is necessary for him to make it known that he is representing another person and to provide the appropriate contact details of the person he is representing so Provider can confirm the order. Provider is authorized to terminate, suspend or not to create any parts of User’s account or entire account (either domain name registration or web hosting part) if any portion of User’s contact information is inaccurate, untrue, not up-to-date or incomplete. Provider maintains the right to seek legal remedy against those who knowingly provide inaccurate information by misrepresenting themselves in violations these aforementioned requirements. 3. Account payment User agrees that for setting up his account Provider will bill User’s credit card or WebMoney system purse (What do we call our payment options) for the amount that stay in conformity with the price of the chosen web hosting plan and billing period. Your credit card is charged at once and in advance for the whole billing period. Domain name registration is not subject to cancellation (after 24 hours from the time of the registration has passed) and refund (if User uses paid domain name registration). Payments are to be made using secure payment gateway, prices are in either US dollars only and payment is made via accepted credit cards.   4. Changing your hosting account plan and billing cycle User agrees that for setting up his account Provider will bill User’s credit card or WebMoney system purse for the amount that stay in conformity with the price of chosen web hosting plan and billing period. Your credit card is charged at once and in advance for the whole billing period. Domain name registration is not subject to cancellation (after 24 hours form the time of registration have passed) and refund (if User uses paid domain name registration). Payments are to be made using secure payment gateway, prices are dominated in either US dollars or EURO and payment is made via accepted credit cards. Account change can be made from User's control panel. The User can see the procedure and the manual instructions from the control panel directly. From a billing point of view all that happens when User changes his hosting plan is that his current billing period will be closed, the remaining pre-paid but unused amount of the previous plan and billing cycle will be credited to his hosting account balance. A new billing period will be opened and the amount of the new hosting plan and billing cycle minus the current account balance will be charged. When plans downgrade takes place, the difference in plans prices will be added to User's account credit balance and he can take this money back only if he cancels hosting account. 5. Renewals of web hosting account and domain name registration Provider does not renew web hosting accounts automatically. When User’s hosting account is due to expire Provider will send him notifications via e-mail one week, 3 days and one day prior to his hosting account expiration day. User should then login to his user manage page and click on renew account button. Attention: Domain names that User registered with Provider are not renewed automatically. Before manually renewing them it is necessary for User to update his contact information. Please always keep in mind your domain name registration period and date of your domain name expiration so that you renew them prior to expiration date and exclude any downtime caused by your domain unavailability. The user is obliged to pay the service renewal bill within 5 days from the date of web hosting account expiration. In the case when the payment was not received account is suspended till the bill is paid. Account is suspended for 30 days if the payment for account renewal is not received. Attention: If the account was not paid and renewed within 30 days of the date of account expiration, account is deleted from the web server without possibility of account data restoration. 6. Whois privacy service terms and conditions User may order domain name registration with Whois privacy service. The Whois privacy service cost is the monthly fee multiply the number of months within domain name registration period. By requesting of the Whois privacy service User expressly agrees that Provider, acting as authorized Reseller of Tucows, doing so on User’s behalf. User agrees that when Whois privacy service is ordered the domain name Registrant and Contacts will display contactprivacy.com. Tucows postal address and Tucows assigned mail address shall appear on behalf of the Registrant and Contacts. The primary and secondary domain name servers (DNS) will be those designated by the Registrant. The original date of the registration and expiration date will be displayed. Tucows will be displayed as the registrar of record. At this Provider may request User’s written confirmation, signed and sent to Provider by fax, scanned and e-mailed or sent by a post mail. Provider guarantees that on User’s first request when he cancels Whois privacy service the information that he has provided at the time of the initial registration of the domain name will be displayed. Whois privacy service fee is charged in advance for the whole period of the ordered service. User solely agrees that Provider may disclose the Registrant's information upon request from either the Registrant, the Registrar, from any third party pursuant to a dispute policy, court action, or for any other lawful purpose. 7. Refund policy Provider has developed and strictly adheres to the following refund policy for web hosting services. The refund policy includes a number of guarantees, such as a 30-day money back guarantee and an anytime money back guarantee. If Provider does not meet User’s requirements or User has other reasons, then User is free to cancel the web hosting account with Provider, and User will receive a refund according to the following terms. · If User is within first 30 days of his web-hosting contract Provider will return him 100% of money he has paid for web hosting minus cost of domain name registration if User gets it as a free domain registration accompanying User’s hosting plan ordered for 3 month or more. · If more than 30 days have passed since User’s web hosting account was established Provider’s any-time guarantee would apply. The terms of this option are that User will receive a refund of the unused prepaid portion of money. The account balance will be calculated on a daily basis. User can easily view his web hosting account balance by using the user control panel. The amount of the refund will be equal to the account of balance in User account on the day the cancellation is effective. In this case domain registration cost is not deducted. This refund policy will apply to all web hosting packages regardless of the currency used for payment or the billing period chosen. All requests for account cancellation must be submitted in writing. It will be necessary for User to provide the real reason for canceling the account. At this time Provider’s customer care team will attempt to respond to User’s needs in a positive way in order to meet the requirements, and needs of User in order to correct any issues and satisfy User. If User has more than one web hosting account with Provider and only cancels one of them, the refunded amount cannot be transferred to any other of User’s web hosting accounts that User has with Provider. If User has requested a refund, but still has unpaid over usage fees due, User will be financial responsible to pay for the excess traffic used over the amount allocated to him by his web hosting plan. The refund fees should be transferred within 5 business days after receipt of cancellation request. Refund shall be given in the currency User has chosen at the moment of ordering web-hosting account. The refund policy doesn't cover: Fees for traffic over usage paid according to web hosting Terms of Services; Domain name registration cost if User chose monthly payment method for web-hosting account, according to which User should pay for domain name registration. Domain name registration, domain name registrations transferred to Provider, and domain name renewal charges are not refundable after the first 24 hours since the registration or renewal has taken place. This is due to ICANN policy and regulations. The domain name is registered in User name and he is the sole owner of that name. Attention: Domain name registrations in .ru and .su domain zones are not refundable at all due to the policy of Regtime (webnames.ru) of which Provider acts as authorized reseller of the domain name registration. 8. Privacy of your contact information and security of your account Provider does not resell or use User’s Registration Data for any purposes not stated in these TOS and/or Privacy policy. Provider keeps the right to contact User for notifications regarding web hosting account services changes or activities affecting the account. Provider may disclose information, including information that User may consider to be confidential in order to comply with court order, subpoena, discovery proceeding, warrant, and governmental request. When User’s account is set up, he will receive a letter with information necessary to access his account. User is responsible for maintaining the confidentiality of the password and account and is fully responsible for any activities that occur under his password and account including those performed by third party, granted access to the Services by User. User agrees to immediately notify Provider of unauthorized use of his password or account or any other breach of security and ensures that he exit his account at the end of each session. User must use Log out function. Provider is not responsible for any loss or damage arising from User’s failure to comply with this provision of TOS. 9. Use of Services and resources, member conduct and prohibited content/actions User is solely responsible for the content of any postings, data or transmissions using the Service, or any other use of the Services by User, or by any person who gained access to the Users account/Content. All services distributed by Provider may be used for lawful purposes only. User's use of the Service is subject to all applicable local, state, national and international law and regulations. User agrees not to transmit through the service any harassing, unlawful, libelous, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature. User totally agrees not to transmit any material that encourages conduct that could constitute criminal offence, gives rise to civil liability or otherwise violates any applicable local, state, national and international law and regulations. User agrees not to use Service for upload, post, email, transmit or otherwise make available any Content that is unlawful, threatening abusive, hateful or racially, ethnically or otherwise objectionable, Content that could harm minors in any way Not to use service for bank phishing, or transmitting confidential information of any person, for pyramid schemes; upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; to use Service for multi-level marketing; not to use Service for "junk-e-mail", "spam", "chain letters", or any other form of solicitation; upload, post, email, transmit or otherwise make available any materials that contains software viruses or any other computer codes that could harm the server or affect any other party, this includes but not limited to any type of server daemons. Illegal adult content and sites linking to illegal adult content are strictly prohibited. Non-acceptable Content or links include: pirated, warez, copyrights software; hacking/cracking related websites; materials that are against public policy; sites containing or linking to any material that may be considered detrimental to the public health, safety or welfare (such as but not limited to: anarchists cookbooks, bomb making, weapon information/sales or anything else that may be considered detrimental or illegal). Provider will be the sole arbitrator as to what constitutes a violation of this provision and reserves the right to deactivate, suspend or terminate the User's account. If User's activity is detected and considered to be a violation of the TOS it could be a cause for suspension of the account. User acknowledges that it is prohibited to upload, post, email, transmit or otherwise make available any Content, including, but not limited to text, software, music, sound, photographs, video, graphics protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. User agrees to remove any such Content at once if requested by the Provider. User is only permitted to use aforementioned copyrighted Content if the User has in their possession documented proof of authorization and must provide such documents to Provider upon request. All materials uploaded to the server must be associated with User's web sites. Off-line storage is strictly prohibited and User agrees to remove any Contents upon Provider's request. This also refers to storage of unreasonable amount of e-mails on the mail server. There is no backup on the mail server and thus Provider strictly recommends User to save important e-mails to his hard drive and store e-mails locally. If Provider's system administration determines that User’s account is utilizing an unacceptable amount of system resources, Provider may temporarily deactivate the account/part of account in question. Provider will be the sole arbitrator as to what constitutes a violation of this provision. Because of the nature of this provision, each account will be considered and analyzed individually. Each account has a certain limit of disk space and bandwidth. When User will be reaching the bandwidth limit he'll be sent a notification e-mail informing User thereof. Once the bandwidth limit is exceeded the account will be temporarily closed until the User pays for the overused GBs of bandwidth. User agrees that Provider at its sole discretion and at any time may terminate, deactivate, discontinue the Service or suspend User account if it is considered that User has violated any provision of this TOS and if User has acted inconsistently with the letter of spirit of the TOS. 10. Limitation of Liability User’s correspondence or business operations, participation in any promotions, advertising activity he carries out through the Service, including payment, mail correspondence, delivery (order procedures) of any related goods or his services, and any other terms, conditions, warranties or representations associated with such operations, are solely between User and his customers that represent third parties. User agrees that Provider is not dealing with any third parties and shall not be responsible or liable for any loss or damage of any sort incurred as the result of User unavailability for any reasons to use Service. User expressly understands and agrees that Provider shall not be liable for any direct, indirect, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use or inability to use the Service, unauthorized access to any or all parts of account, alteration of User’s data, statements or conduct of any third parties on the service or any other matter relating to the Service. User is not authorized to demand Provider to cover any losses resulting from using or inability to use the Service at the rate more than he has paid for the Service as provided in money back guarantee. 11. Account cancellation, termination of services, suspension of account User has right to cancel account at any time by written notice to Provider and has right to demand refund as per applicable money back guarantee. Upon termination of the Service, User's right to use the Service immediately ceases. Provider is entitled to terminate account with notification sent beforehand if it is considered that User has violated any provision of the TOS. Provider shall not be liable to User or any third party for the termination of the account. 12. Changes to the TOS and modifications to Service Provider keeps the right to make any modifications at its sole discretion to the TOS or any its provisions without any preliminary notice sent to User. 13. Support abuse Provider does his best in order to provide Users with the best services available on the market and treat each User with utmost respect. In return, Provider expects the same from Users. Please note if Provider’s staff feels that User is consistently addressing them in a demeaning manner, his chat session will be closed and tickets with abusive lexis or written in insulting manner will not be answered/considered. 14. Guarantees Provider has designed a number of Guarantees that will make User confident in choosing him as User’s Provider of web hosting services. These are: 30-days money back guarantee, refund guarantee/any time money back guarantee, support guarantee, prize-freeze guarantee. Provider will constantly review his guarantees in order to bring them in conformity with his User’s needs and achieving User's 100% brand loyalty and complete satisfaction.
